"I knew then that I had to follow that desire to serve and solve, and as a result, I wanted to play a meaningful role in policy, politics, and the law."

Michael P. Mallery, Lead Counsel, Gerawan Farming, Inc.

With over 30 years dedicated to law, Mr. Mallery brings a wealth of knowledge to his industry and, in particular, to his areas of specialization, the fields of labor and business law, especially as they relate to agribusiness. When asked about his decision to pursue a career in law, Mr. Mallery said:

"I developed a desire to find solutions and help people at a young age. I was also very interested in politics. As an intern for then-California State Senator Jim Nielson, the Senator tasked me with the responsibility of establishing and implementing Neighborhood Watch groups, which were, at that time, in the very early stages of development. I had the responsibility of coordinating the Neighborhood Watch program with the Police Department throughout the City of Woodland, partly in response to a serial rapist who was attacking elderly women throughout our city. The challenge of engaging the community, the victims, law enforcement, and our elected officials ignited a passion in me to find solutions and justice for all involved. I knew then that I had to follow that desire to serve and solve, and as a result, I wanted to play a meaningful role in policy, politics, and the law."

In his first 24 years of litigation, Mr. Mallery adeptly defended catastrophic personal injury matters and medical malpractice actions for hospitals across Fresno, California. Subsequently, Mr. Mallery went on to handle business litigation matters as the outside Counsel for Gerawan Farming Inc., where he has served as Lead/General Counsel for the past nine years. His practice encompasses Gerawan's internal litigation as well as the supervision and management of all outside counsel in matters of employment law, labor law, trademark, account litigation, and other accompanying areas.

Mr. Mallery has dedicated substantial effort to serving the local community in several regards. He was recognized as San Joaquin College of Law Adjunct Professor of the Year in 2004, where he previously taught civil litigation and remedies. Mr. Mallery also served as Judge Pro-Tem for the Fresno County Superior Court in Juvenile Court.

An AV® Preeminent™ Rated attorney with a reputation for thoughtful and dedicated client service, Mr. Mallery is one of the most renowned attorneys in the industry, known for successfully combining the typically exclusive roles of litigator and General Counsel. His reputation further stems from his litigation experience, ability to successfully oversee outside counsel and experts in complex legal matters, and his superior management of the challenging and extensive labor disputes involving Gerawan Farming.

As a thought-leader in his field, Mr. Mallery strives to balance optimism with pragmatism and understands the hurdles involved in the complex pursuit of labor equality. Achieving the best outcomes for Gerawan Farming has meant immersing himself within the multi-faceted agricultural world and navigating the competing interests therein. Gerawan Farming is renowned throughout the agriculture industry for its high-quality treatment of its employees. Nonetheless, working for Gerawan Farming poses distinctive challenges in a state where the laws that have been put into place to protect farm workers instead create a burdensome bureaucracy that is, at times, detrimental to workers’ best interests. Mr. Mallery noted the difficulty of navigating government regulations and the bureaucracy of the United Farm Workers Union (UFW):

"There is a process in California called Mandatory Mediation and Conciliation (MMC) where the State essentially writes a contract for the workers that is then imposed upon those workers, with neither the company nor the workers having a say in their own fate. In particular, the workers of our company were faced with a daunting situation. After a nearly two-decade absence, the United Farm Workers Union appeared one day and announced they were there to represent our workers and to negotiate a contract. Keep in mind, nearly 98% of our current workers were not even employed at Gerawan twenty years prior, when the union had earned representation. As such, the workers fought for their right to hold an election so they could decide whether or not to be represented by a union that had abandoned them twenty years before."
